Google and Apple have advised some employees on US work visas to refrain from international travel due to significant delays in visa processing at embassies. According to internal memos reviewed by Business Insider, both companies' legal representatives have communicated that visa stamping appointments are currently experiencing delays of up to 12 months, which poses a risk of employees being stranded outside the US if they leave the country.
The memo from BAL Immigration Law, representing Google, explicitly warned employees who require a visa stamp to re-enter the US about the potential complications of international travel. It stated, "Please be aware that some US Embassies and Consulates are experiencing significant visa stamping appointment delays," and recommended that employees avoid travel to mitigate the risk of an extended stay outside the US.
Similarly, a memo from Fragomen, a law firm representing Apple, echoed these concerns, advising employees without a valid H-1B visa stamp to postpone any international travel. The memo highlighted the unpredictability of delays and urged employees to consult with Apple Immigration and Fragomen if travel could not be avoided.
The delays in visa processing are largely attributed to new social media screening requirements introduced by the US government, which apply to H-1B visa workers and their dependents, as well as students and exchange visitors. A spokesperson for the Department of State confirmed that they are conducting "online presence reviews for applicants," which has contributed to the backlog.
The H-1B visa program, which is crucial for the US technology sector, allows companies to hire skilled foreign workers, particularly from countries like India and China. However, the program has faced increased scrutiny and regulatory changes under the Trump administration, including a $100,000 fee imposed on new applications and enhanced vetting processes.
The advisories from Google and Apple reflect a broader trend among corporations in the US to caution employees about international travel, particularly for those on work visas. Immigration attorney Jason Finkelman noted that foreign nationals typically can return to the US after travel if they possess a valid visa stamp. However, the enhanced vetting processes can complicate this, as delays in obtaining a new visa stamp can leave employees stranded abroad.
During the 2024 government fiscal year, Google applied for 5,537 H-1B visas, while Apple submitted 3,880 applications, highlighting the reliance of these tech giants on skilled foreign labor.
Neither Google nor Apple provided immediate comments regarding the advisories. The situation underscores the challenges faced by visa holders in the current immigration landscape, where processing delays and regulatory changes can significantly impact their ability to travel and work in the US.
As the visa processing situation evolves, employees are advised to stay informed and consult with their respective immigration representatives to navigate the complexities of international travel while holding a US work visa.
